Article 51 — Coordination of notified bodies

The Commission shall ensure that appropriate coordination and cooperation between notified bodies are put in place and properly operated in the form of a cross-sectoral group of notified bodies.

Member States shall ensure that the bodies notified by them participate in the work of that group, directly or by means of designated representatives.

Participation carries a sanction, and it is narrower than it first reads. Member States must ensure their notified bodies take part in the group under Article 51(2). The Blue Guide states that where a body refuses to cooperate the notification may be withdrawn, and in the same passage that notified bodies are not obliged to attend meetings at European level provided they keep themselves informed of and apply the administrative decisions and documents their group produces. The group's remit is bounded: its recommendations and administrative decisions are limited to the common understanding of technical aspects of conformity assessment and do not concern the interpretation of the legislation. All of that is established practice as described in the Blue Guide, and it is not mandated by the CRA.
